Governing law and venue
These Terms are governed by the laws of the Republic of Korea without regard to conflict-of-law rules that would select another jurisdiction. Parties agree that courts in Seoul possess non-exclusive jurisdiction, provided mandatory consumer protections remain available where applicable.
FailSafe Academy operates training programs and related materials for professional development. Where a statute grants you non-waivable rights, those rights prevail over any conflicting sentence in this document.
Participant obligations
You provide accurate registration details, safeguard credentials for live sessions, and follow acceptable use rules during labs. Sharing accounts, attempting to disrupt shared lab environments, or scraping course materials without written permission is prohibited.
You represent that you have authority to bind your employer when registering with a corporate email domain, unless you notify us in writing that you attend in a personal capacity.
Services described
Programs include scheduled instruction, documented exercises, and mentor feedback as described on each course page. We may update syllabi to reflect tooling changes while preserving stated learning objectives.
Materials are licensed for personal or internal organizational learning during enrollment. Redistribution, resale, or incorporation into competing courseware is not permitted without a separate written license.
Suspension and termination
We may suspend access for unpaid invoices, abusive conduct, or security incidents affecting cohorts. You may stop attending at any time; refunds follow the Returns & Refunds policy, not informal side agreements.
Upon termination, downloaded resources must be deleted except where law requires retention for evidence. Certificates issued before termination remain valid unless revoked for fraud.
Acceptance and changes
Accessing the site or registering for a program constitutes acceptance of these Terms. We publish material changes with a revised date at the top of this page and, where practical, email administrators of active cohorts.
Continued use after the effective date of changes constitutes acceptance unless applicable law requires explicit consent for a particular change.
Intellectual property
FailSafe Academy retains rights in curricula, labs, trademarks, and site design. You receive a limited, non-exclusive license during enrollment. Feedback you voluntarily provide may be used to improve services without royalty, excluding your confidential information clearly marked in writing.
Open-source components used in labs retain their respective licenses; our Terms do not supersede those notices where they apply.
Liability and disclaimers
Training addresses operational readiness and does not guarantee specific business outcomes. To the fullest extent permitted under Korean law, indirect or consequential damages are excluded except where prohibited.
Total liability for any claim arising from these Terms or a program is capped at the fees paid for the specific program giving rise to the claim during the twelve months preceding the event, except for damages caused by intentional misconduct or gross negligence.
Document control
We maintain internal change logs linking each revision to curriculum owners. Public-facing summaries appear through the last updated field above. Archived copies are available upon legitimate regulatory request.
Definitions
“Program” means a scheduled FailSafe Academy offering with stated duration and delivery format. “Materials” means digital artifacts provided during enrollment. “You” means the individual attendee or the organization identified at registration, as applicable.
